Common Time Limits and Case Process

Filing PERB Rule Deadline to File
Arbitration Review Request 538.1 Not later than twenty-one (21) days after the issuance of a grievance arbitration award.
Unfair Labor Practice Complaint
 
520.4 Not later than one hundred twenty (120) days after the date on which the alleged violation occurred or the date the complainant knew or should have known of the alleged violation, if later.
Standards of Conduct Complaint 544.4 Not later than one hundred twenty (120) days after the date on which the alleged violation occurred or the date the complainant knew or should have known of the alleged violation, if later.
Negotiability Appeal

 
532.1-2 Negotiability appeals must be filed within seven (7) days of a finding of impasse by the Executive Director of PERB. Otherwise, the Negotiability Appeal must be filed within thirty-five (35) days after receipt of written communication that proposal is nonnegotiable.
Filing an Answer 502.11 Generally, parties named as respondents have fourteen (14) days to file an answer to a complaint or petition.
 
Motion for Reconsideration of an Executive Director’s decision 500.7 A party may file a Motion for Reconsideration within 28 days of receipt of the Executive Director’s decision.
Motion for Reconsideration of a Board order 559 A party may seek reconsideration of a Board order within fourteen (14) days of issuance.
Appeal of a Board order to Superior Court D.C. Official Code § 1-617.13 A party may appeal a Board order within thirty (30) days of issuance to the D.C. Superior Court
Post-Hearing Briefs 552.2 Parties usually have thirty-five (35) days to file post-hearing briefs after the hearing transcript becomes available.
Exceptions and oppositions 553.2 A party may file exceptions and a brief in support of the exceptions no later than fourteen (14) days after service of the hearing examiner’s report and recommendations. A response or opposition to the exceptions may be filed by a party no later than fourteen (14) days after service of the exceptions.
Motion for extension of a filing 501.2 A motion for an extension or reduction of time must be in writing and made at least three (3) business days before the expiration of the filing period.
